Legal analysis of the conduct of Israel in Gaza pursuant to the Convention on the Prevention and Punishment of the Crime of Genocide (A/HRC/60/CRP.3)

This is the UN Human Rights Council’s Independent Commission of Inquiry’s legal analysis concluding that Israeli authorities have committed genocide in Gaza since October 2023, including four of the five acts under the Genocide Convention, and identifying statements as direct evidence of genocidal intent.

This detailed HRW report (179 pages) documents how Israeli authorities systematically deprived Gaza’s civilian population of water, destroyed water and sanitation infrastructure, and restricted repair and fuel access. It argues that such actions constitute an act of genocide (via “conditions of life … calculated to bring about physical destruction”) and the crime against humanity of extermination.

In this report, the UN Special Rapporteur on the occupied Palestinian territory (Francesca Albanese) analyses Israeli policies and patterns of destruction in Gaza to argue that there are reasonable grounds to believe the threshold for genocide has been met.

In this binding order, the International Court of Justice required Israel to “prevent genocide” against Palestinians in Gaza, to ensure the unhindered provision of humanitarian assistance (water, food, medicine, fuel), and to prevent and punish incitement to genocide.
